A Last Will and Testament is an Estate Planning tool that states your wishes for the distribution of your Probatable Estate. This document is only used in connection with Probate Court Proceedings. A Last Will and Testament does not assist in avoiding the need for Probate Court Proceedings in any way.
WHAT IF YOU DO NOT HAVE A LAST WILL AND TESTAMENT?
If you do not have a Last Will and Testament in place, your Probatable Assets will be distributed according to the laws set forth by your State and Federal Law.
